Atari is threatening sites that posted reviews before the release date claiming the "only" way they could have got it is by pirating it.

The only conceivable explanation would be that your" test "on an illegally downloaded version is based.

I guess the concept of stores breaking release dates is alien to them. Can't help but notice they're targeting the sites with negative reviews as well.

i don't know, but even if they could get a legal copy early (which they no doubt could as the game has been in stores for a few days now) could they actually have activated it?

normally, activation servers go online only on the release date or shortly beforehand.

i even seem to recall that some users who got a copy early claimed they couldn't activate it because of no servers.

Yeah, activation is controlled by Atari so they know who has used a legal copy or not. I presume they will have granted some review sites early activation serials.

people can activate the game already. you not seen the forums? and the 360 version does not need activation.

Well the game is out now so you should be able to activate. With the 360 version there are the additional controls that XBox Live brings, and Microsoft can track game usage and ban you through that (for single player games too).
